These Terms and Conditions (“Terms”) govern applications, purchases, enrolments, access to and participation in courses, educational pathways, workshops, immersions, events, continuing education, practitioner education, certification pathways, online offerings and other services provided by Flip180 Pty Ltd trading as Peiec International (“Peiec International”, “we”, “us” or “our”).

Please read these Terms carefully before purchasing, enrolling in or participating in an offering.

By purchasing, enrolling in, accessing or participating in an offering, you agree to these Terms together with any specific program information, enrolment terms and separate agreement applicable to that offering.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

1. ABOUT PEIEC INTERNATIONAL

Peiec International is operated by Flip180 Pty Ltd in Australia.

Peiec International provides education in the peiec® methodology, including online learning, self-application, practical education, continuing education, immersions, events and, where applicable, practitioner education and certification pathways.

Different offerings may have different eligibility requirements, inclusions, access periods, participation requirements, fees and terms. These will be communicated through the relevant program information, application or enrolment process, or separate agreement.

2. ELIGIBILITY AND ACCEPTANCE

Some Peiec International offerings may be available for direct purchase, while others require an application, eligibility assessment or acceptance process.

Submitting an application, selecting an application-conversation time or expressing interest does not guarantee acceptance into an offering.

Where an application or eligibility process applies, Peiec International may consider factors reasonably relevant to the particular offering, including an applicant’s experience, readiness, understanding of the offering, willingness and ability to participate in essential components, previous engagement with peiec®, and suitability for the learning environment.

We may decline an application where we reasonably consider that the offering is not appropriate for the applicant, capacity has been reached, eligibility requirements have not been satisfied, essential participation requirements cannot reasonably be met, or for another legitimate reason connected with the offering.

3. THE FIRST GATE APPLICATION PROCESS

The First Gate is the eight-month online entry into the peiec® pathway.

Entry into The First Gate is by application and acceptance.

Prospective students are expected to meaningfully explore the information provided about peiec®, The Work, The Pathway and The First Gate before applying.

Applicants may be required to complete written application questions and select a provisional time for an application conversation.

Applications are reviewed before an application conversation is confirmed. Selecting a time does not guarantee that the application will progress to a conversation.

Where an application progresses, the applicant will ordinarily participate in an initial online application conversation.

The purpose of this conversation is to learn more about the applicant, their reasons for wanting to enter the pathway, their understanding of the nature and requirements of The First Gate, and whether there appears to be an appropriate fit between the applicant and the program.

The application conversation is not intended to replace the program information available through Peiec International or operate as a general introductory or exploratory consultation about peiec®.

Where Peiec International considers that an applicant has not sufficiently explored or understood the available information before the conversation, the conversation may be concluded and the applicant may be invited to spend further time with the available resources before applying again.

Where both the applicant and Peiec International consider that there may be an appropriate fit, the applicant will ordinarily be provided with a consideration period of approximately five to seven days before a second conversation or final enrolment decision.

This period allows the applicant time to consider the commitment, structure, participation requirements, applicable fees and other material conditions before deciding whether to proceed.

Acceptance into The First Gate is not complete until Peiec International has confirmed acceptance and the applicant has completed the applicable enrolment requirements.

4. THE FIRST GATE

The First Gate is an eight-month online educational experience and the entry point into the peiec® pathway.

Depending upon the structure offered at the time of enrolment, The First Gate may include:

online coursework and filmed teachings;
live online teaching and webinars;
self-application and practical exercises;
opportunities to practise with other students;
opportunities to receive from other students;
group practice;
access to a private online community;
opportunities to ask questions and participate in live education;
educational resources and supporting materials; and
other components expressly identified in the applicable program information.

The First Gate is participatory education. Students are expected to engage with the work rather than treat the program solely as recorded material to be watched independently.

Participation may include learning and applying techniques to oneself, practising with other people, receiving from other people, attending or engaging with live education where reasonably possible, and participating appropriately in the wider learning environment.

Specific schedules, live-session frequency, platforms, resources and other delivery arrangements may change reasonably over time while preserving the substantive nature of the offering purchased.

5. EIGHT-MONTH ACCESS PERIOD

Unless otherwise expressly stated in writing, access to The First Gate is provided for eight months from the commencement or access date specified by Peiec International.

Students are responsible for making reasonable use of the program during that period.

Failure to view content, attend available live sessions, participate, practise, complete coursework or otherwise make use of the program does not automatically entitle a student to an extension, refund or credit.

Access does not automatically extend because a student begins late, pauses their participation, experiences personal or scheduling difficulties, or does not complete available material within the eight-month period.

Any extension must be expressly approved by Peiec International unless otherwise required by law.

6. CONTINUING PEIEC® PATHWAY

The First Gate is the beginning of the peiec® pathway rather than the entirety of the work.

Peiec International may offer eligible students opportunities to continue their education and development beyond The First Gate through further online education, continuing pathway participation, advanced education, live teaching, practice opportunities, immersions, workshops, practitioner education, certification pathways or other offerings.

Progression beyond The First Gate is not automatic.

Peiec International may consider a student’s engagement, participation, practical experience, readiness, understanding of the work, conduct, suitability for the continuing learning environment and any other requirements reasonably relevant to the next stage of education.

Completion of The First Gate does not create an automatic entitlement to enter every subsequent Peiec International offering.

The structure, duration, inclusions, access period, participation requirements and fees applicable to continuing education will be communicated before a student elects to participate.

Peiec International may develop, revise, rename or expand its educational pathway over time. Changes to future pathway structures do not retrospectively alter education already undertaken or certification previously validly granted unless expressly agreed or required by law.

7. PROGRAM INFORMATION AND INCLUSIONS

The inclusions of any Peiec International offering are those expressly identified in the applicable program information or enrolment documentation at the time of enrolment.

Unless expressly stated otherwise, purchasing or completing one Peiec International offering does not provide access to other courses, programs, workshops, events, immersions, continuing education, memberships, certification pathways or future offerings.

Students should refer to the specific information provided for the offering they are purchasing.

8. ACCESS TO COURSEWORK AND EDUCATIONAL RESOURCES

Access to Peiec International online coursework, recorded materials, webinars, practice opportunities, community resources and other educational resources is provided only for the applicable program or participation period.

When that period expires, is terminated or is not renewed, access to those resources will cease unless otherwise expressly agreed in writing.

This may include cessation of access to:

online coursework;
course videos and recordings;
educational materials;
webinars and live online sessions;
practice sessions;
community resources;
new or continuing educational material; and
other resources made available through the applicable offering.

Previous enrolment, completion of education or certification does not provide lifetime access to Peiec International coursework, recordings, webinars, educational resources or continuing education unless expressly stated otherwise in writing.

Materials expressly provided for permanent download or retention may continue to be retained subject to applicable intellectual property, confidentiality and use restrictions.

9. AUSTRALIAN IMMERSIONS

Peiec International may offer in-person Australian Immersions as part of the continuing peiec® pathway.

Unless expressly stated otherwise in writing, Australian Immersions are separate offerings and are not included in the fee for The First Gate or another online Peiec International offering.

Payment for The First Gate does not create an entitlement to attend an Australian Immersion.

Similarly, payment for or attendance at one Australian Immersion does not create an entitlement to attend any future immersion.

Immersions are designed for eligible people who already have relevant experience within the peiec® pathway. They are not ordinarily introductory five-day courses for people who have no prior experience of the work.

10. IMMERSION ELIGIBILITY AND READINESS

Eligibility for an Australian Immersion may depend upon the participant’s position within the peiec® pathway, participation, practical experience, familiarity with relevant material, readiness and the particular content or requirements of the immersion.

Peiec International may require participants to:

hold current access to relevant Peiec International education or continuing pathway participation;
have completed relevant foundational education;
have sufficient practical experience applying relevant techniques;
have experience working with and receiving from other people;
have participated appropriately in the wider learning environment;
complete specified preparation before attendance;
satisfy applicable participation and safety requirements;
be familiar with techniques or material required for that immersion; and
satisfy other reasonable readiness requirements communicated for the particular immersion.

Readiness is assessed through participation and experience rather than solely by the amount of time that has passed.

Previous peiec® education, attendance or certification does not, by itself, create an ongoing entitlement to attend future immersions.

Peiec International may approve attendance, re-entry or another arrangement in particular circumstances. Any such arrangement is subject to approval, availability, applicable fees and any conditions specified by Peiec International.

An exception made in one circumstance does not create an entitlement or precedent for future participation.

11. IMMERSION PREPARATION AND PARTICIPATION

Australian Immersions involve participants working with and receiving from other people.

Participants are therefore responsible for completing any preparation reasonably required for the particular immersion and arriving with sufficient familiarity with the relevant material.

A participant who arrives without adequate preparation may affect both their own learning and the experience of other people who are asked to work with or receive from them.

Where a participant has not met applicable preparation, participation, practical or safety requirements, Peiec International may reasonably:

modify the participant’s involvement in particular activities;
require additional preparation;
restrict participation in particular practical components;
defer attendance where appropriate; or
require the participant to leave or discontinue the immersion where necessary to protect the safety, integrity or reasonable operation of the learning environment.

Any financial consequences will be determined having regard to the circumstances, services already provided, these Terms and applicable law.

12. IMMERSION BOOKINGS AND PLACES

A confirmed immersion place is reserved for the participant and should be treated as a commitment to attend that particular immersion.

Immersion places are limited and may involve advance commitments by Peiec International including venue hire, staffing, teaching, administration and program planning.

A confirmed booking does not provide an automatic right to transfer to another immersion for convenience, change of mind or personal scheduling.

Peiec International may consider a transfer request where exceptional circumstances arise.

Whether a transfer is approved will depend upon the circumstances, timing of the request, availability of places and other reasonably relevant factors.

An approved transfer may be subject to reasonable administrative conditions, additional costs or differences in pricing where applicable.

A discretionary transfer or accommodation granted in one circumstance does not create an entitlement or precedent for another circumstance.

13. IMMERSION CANCELLATION BY A PARTICIPANT

Unless different cancellation terms are expressly disclosed and agreed for a particular immersion, the following cancellation provisions apply.

More than five months before commencement

A participant who cancels more than five months before the immersion commencement date may receive a refund of immersion fees paid, less a $299 administrative fee, subject to any rights available under applicable law.

Refunds will ordinarily be processed to the original payment method.

Between three and five months before commencement

Where a participant cancels between three and five months before commencement, a refund of immersion fees paid, less the $299 administrative fee, may be provided where:

the participant identifies a suitable replacement attendee who is independently approved by Peiec International and satisfies applicable eligibility requirements; or
Peiec International is able to fill the participant’s place from a waitlist or another eligible applicant.

A participant does not have an automatic right to transfer or assign their place to another person.

Within three months of commencement

Because of the substantial advance preparation and commitments associated with Australian Immersions, fees are ordinarily non-refundable for participant cancellation within three months of commencement.

Exceptional circumstances may be considered by Peiec International on a case-by-case basis.

Nothing in this section excludes or limits any refund, remedy or other right that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

14. IMMERSION NON-ATTENDANCE, LATE ARRIVAL AND EARLY DEPARTURE

Failure to attend a confirmed immersion does not ordinarily entitle the participant to a refund, credit or replacement immersion.

Late arrival, missed days or a participant’s decision to leave an immersion early does not ordinarily entitle the participant to a refund or credit for the missed portion.

No refund or credit is ordinarily provided for immersion time missed because of personal travel delays, missed flights, transport disruption or other circumstances relating to the participant’s travel arrangements.

Exceptional circumstances may be considered on a case-by-case basis.

Nothing in this section limits rights or remedies that cannot lawfully be excluded.

15. IMMERSION FEES AND INCLUSIONS

Unless otherwise expressly stated in writing, an immersion fee applies only to the official immersion and the inclusions identified in the applicable booking information.

Unless expressly included, immersion fees do not include:

flights;
visas;
travel insurance;
accommodation;
transportation;
meals;
personal expenses;
tourist activities; or
third-party bookings or services.

Participants are responsible for arranging and paying for these independently.

16. TRAVEL RESPONSIBILITY

Participants attending in-person offerings are responsible for their own travel arrangements.

This includes responsibility for circumstances such as:

flight delays or cancellations;
missed connections;
lost luggage;
visa or passport issues;
illness or injury during travel;
transport disruptions; and
geopolitical, weather-related or other travel disruptions.

Participants are strongly encouraged to obtain comprehensive travel insurance and, where possible, make flexible or refundable travel arrangements.

To the extent permitted by law, Peiec International is not responsible for third-party travel, accommodation or other personal expenses incurred because of a participant’s travel arrangements or because an event is changed, postponed or cancelled.

17. PAYMENT

Program and offering fees will be disclosed before enrolment or purchase.

Unless expressly agreed otherwise in writing, fees for The First Gate and other Peiec International educational offerings are payable in full in accordance with the payment requirements communicated during enrolment.

Payment plans are not available unless Peiec International expressly agrees otherwise in writing for a particular offering or circumstance.

Where payment is required before access, commencement or attendance, the participant will not receive access or be permitted to attend until the required payment has been received.

Peiec International may suspend access or withhold participation where amounts properly due remain unpaid, subject to applicable law.

18. REFUNDS AND CHANGE OF MIND

Peiec International does not ordinarily provide refunds merely because a participant:

changes their mind;
experiences a change in personal circumstances;
decides an offering is no longer suitable for their personal goals;
fails to participate;
does not complete coursework;
does not use available resources;
experiences scheduling conflicts;
chooses to withdraw; or
is unable to complete an offering within the applicable access period.

The First Gate involves a considered application process designed to provide applicants with an opportunity to understand and consider the offering before making their commitment.

Where an applicant has been accepted, elected to proceed, completed enrolment and been provided access to the program, fees paid are not ordinarily refundable merely for change of mind or the other reasons described above.

Specific cancellation provisions applying to Australian Immersions are set out separately in these Terms.

Australian Consumer Law

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Where a participant is entitled to a remedy under applicable law, these Terms do not prevent them from exercising that right.

19. ACCESSIBILITY, PARTICIPATION AND REASONABLE ADJUSTMENTS

Peiec International welcomes enquiries from people who may require reasonable adjustments to access or participate in our offerings.

Peiec International education may include practical body-based learning, self-application, observation, partner work, touch and non-contact techniques, demonstrations, movement, practical exercises and other experiential learning activities.

Participants must be able to safely participate in the essential components and learning requirements of the relevant offering, with reasonable adjustments where appropriate.

Where an applicant or participant has a disability or other circumstance that may affect their ability to access or participate, Peiec International will consider reasonable adjustments in consultation with the person where appropriate.

The purpose of a reasonable adjustment is to support access and participation without removing or fundamentally altering essential learning, competency or safety requirements.

An adjustment may not be possible where it would fundamentally alter an essential component or learning outcome, prevent a required competency from being appropriately demonstrated, create an unacceptable or unmanageable safety risk, impose unjustifiable hardship, or otherwise be unreasonable in the circumstances.

Applicants and participants are encouraged to raise accessibility or participation requirements as early as reasonably possible so that potential adjustments can be considered before relevant education or activities take place.

Where an applicant cannot safely participate in essential requirements even with reasonable adjustments, Peiec International may determine that the particular offering is not suitable for that applicant.

Any such decision will be made having regard to individual circumstances and applicable law rather than solely on the basis that a person has a particular disability, diagnosis or condition.

20. CHANGES TO PROGRAMS AND OFFERINGS

Peiec International may make reasonable changes to the organisation or delivery of an offering where necessary to maintain or improve delivery or respond to circumstances outside our reasonable control.

This may include reasonable changes to schedules, session times, venues, teaching sequences, delivery platforms, supporting materials, facilitators, teaching assistants or administrative arrangements.

Because peiec® is a continuing body of work, educational material may also be reasonably refined, expanded or reorganised over time.

We will not use this provision to materially reduce the overall service purchased without providing an appropriate response or remedy where required by law.

21. POSTPONEMENT OR CANCELLATION BY PEIEC INTERNATIONAL

Occasionally, an event, immersion or live component may need to be postponed, relocated, rescheduled or cancelled due to circumstances including illness, venue unavailability, insufficient attendance, travel disruption, natural events, government restrictions, emergencies, technical failure or circumstances outside Peiec International’s reasonable control.

Where reasonably possible, Peiec International will provide affected participants with notice and an appropriate alternative arrangement.

Depending upon the circumstances, this may include rescheduling, transfer to another intake or event, alternative delivery, credit, or refund of an affected component where required or appropriate.

Nothing in this section limits any remedy available under applicable law.

22. PARTICIPANT CONDUCT

Participants are expected to behave respectfully, appropriately and professionally toward other participants, students, staff, facilitators, contractors, venue personnel and guests.

Participants must not engage in conduct that is unlawful, threatening, abusive, harassing, discriminatory, seriously disruptive, deliberately deceptive, unsafe, a serious or repeated breach of reasonable boundaries, a breach of another participant’s confidentiality, a serious misuse or misrepresentation of peiec®, or otherwise materially detrimental to the safety, integrity or reasonable operation of the learning environment.

Participants must not attend an in-person offering while materially impaired by alcohol or illegal substances.

Peiec International may take reasonable and proportionate action in response to serious or repeated misconduct, including issuing directions, restricting participation, requiring a participant to leave an event, suspending access or terminating participation.

Any refund or other financial consequence arising from termination for misconduct will be determined having regard to the circumstances, services already provided, loss caused, these Terms and applicable law.

23. CONFIDENTIALITY AND RESPECT FOR OTHER PARTICIPANTS

Courses, practice groups, webinars, immersions, community spaces and other Peiec International environments may involve participants sharing personal information or experiences.

Participants must respect the privacy and confidentiality of other participants.

Personal information, stories, photographs, recordings or experiences shared by another participant in a private Peiec International learning environment must not be publicly disclosed or used without that person’s permission.

This obligation does not prevent a person from seeking professional, medical or legal assistance, making a lawful complaint, reporting unlawful conduct or making another disclosure protected by law.

24. PEIEC® INTELLECTUAL PROPERTY

peiec® is an original body of work developed through Anandi Sano.

All rights in the peiec® methodology and associated intellectual property and proprietary materials are owned by or licensed to Flip180 Pty Ltd, as applicable.

Peiec Intellectual Property and Materials may include, without limitation:

techniques and applications;
processes and sequences;
movements and methods;
frameworks and structures;
the five layers and associated teaching materials;
demonstrations;
diagrams and illustrations;
written materials;
manuals and coursework;
presentations;
video and audio recordings;
educational materials;
training structures;
practitioner materials;
proprietary terminology;
online content; and
other proprietary materials developed for or forming part of peiec®.

Purchase of or participation in a Peiec International offering does not transfer ownership of Peiec Intellectual Property or Materials to the participant.

Except where expressly authorised by Peiec International or under a separate written Student, Practitioner or other agreement, participants must not copy, reproduce, distribute, publish, upload, disclose, sell, license, teach, train others in, adapt, repackage, commercialise or create educational, training or certification products from Peiec Materials.

Participants must not represent Peiec Intellectual Property or Materials as their own creation or remove copyright, trade mark or other proprietary notices.

Specific rights to professionally apply peiec® may be granted under applicable education, certification or practitioner arrangements.

Permission to practise or professionally apply peiec® does not, by itself, confer permission to teach, train or certify others in peiec®.

Peiec International reserves all rights not expressly granted.

25. ONLINE ACCOUNTS AND COURSE MATERIALS

Online access is provided to the registered participant only.

Participants must not share login credentials, permit another person to use their account, provide unauthorised access to coursework, download materials where downloading has not been authorised, copy or reproduce protected course materials, screen-record protected content or distribute course materials to another person.

Participants are responsible for maintaining reasonable security over their account credentials.

Peiec International may suspend access where we reasonably believe an account has been compromised, shared or used in breach of these Terms.

26. PARTICIPANT RECORDING

Unless expressly authorised, participants must not photograph, audio-record, video-record, screen-record, reproduce or publicly transmit Peiec International teaching sessions, demonstrations, immersions, course content or private participant interactions.

Permission to record a particular item does not create general permission to record other content.

27. RECORDINGS MADE BY PEIEC INTERNATIONAL

Some online classes, webinars or educational sessions may be recorded by Peiec International for legitimate program delivery, educational or archival purposes.

Where reasonably practicable, participants will be informed when a session is being recorded.

Use of an identifiable participant’s image, voice, testimonial, personal story or private experience for public advertising or promotional purposes will ordinarily be subject to separate appropriate permission.

28. STUDENT, EDUCATION AND PRACTITIONER AGREEMENTS

Participants entering The First Gate, continuing Peiec education, practitioner education, certification pathways or other designated offerings may be required to enter into a separate Student, Education, Practitioner or similar agreement.

Such agreements may contain additional provisions relating to intellectual property, confidentiality, authorised use of peiec®, practice requirements, professional conduct, assessment, competency, certification, practitioner status, use of Peiec names and branding, teaching and training restrictions and ongoing professional obligations.

Where a separate signed agreement applies, it forms part of the participant’s contractual relationship with Flip180 Pty Ltd.

If there is an inconsistency between these general Terms and a specific signed agreement concerning a matter specifically addressed by that agreement, the specific signed agreement will prevail to the extent of that inconsistency.

29. CERTIFICATION AND PRACTITIONER STATUS

The First Gate is an entry into the peiec® pathway and does not, by itself, confer certification or practitioner status.

For some people, the continuing pathway may eventually include the opportunity to pursue peiec® certification.

Where certification is offered, participants must satisfy the requirements applicable to the certification pathway at that time.

Requirements may include relevant education, practical experience, participation, assessments, portfolio requirements, demonstrated competency, professional standards, conduct requirements or other criteria reasonably relevant to certification.

Detailed certification requirements may be contained in applicable program information or Student, Education or Practitioner Agreements.

No participant may represent themselves as holding a particular Peiec certification or practitioner designation unless and until that status has been formally granted.

Certification previously validly granted is not cancelled merely because a practitioner’s access to coursework or continuing participation subsequently ends, unless an applicable Practitioner Agreement or other governing terms provide otherwise.

Certification or practitioner status does not provide lifetime access to Peiec coursework, webinars, educational resources, continuing education or immersions.

Certification or practitioner status does not grant authority to teach, train or certify others in peiec® unless that authority has been expressly granted in writing.

30. PEIEC® PRACTITIONER DIRECTORY

Peiec International may maintain a public directory or listing of people currently working professionally with peiec®.

Eligibility for a directory listing may be subject to criteria established by Peiec International, including current relationship with the pathway, applicable practitioner status, professional information, continuing participation or other reasonable directory requirements.

A directory listing reflects eligibility for inclusion in the directory at that time. It is separate from whether a person has previously been validly granted a certification.

Ending, removing or declining a directory listing does not, by itself, cancel certification previously validly granted.

Peiec International may reasonably update directory eligibility requirements over time.

31. NATURE OF PEIEC® EDUCATION

peiec® is an original body of work encompassing physical, energetic, touch, spatial, perceptual and other experiential practices and applications.

Peiec International education may include educational information, self-application, demonstrations, body-based practices, energetic techniques, subtle touch, non-contact techniques, partner exercises and other learning experiences.

Peiec International education is not a substitute for emergency medical care or for medical, psychiatric, psychological or other appropriately qualified professional healthcare.

Nothing in a Peiec International offering should be interpreted as a direction to discontinue prescribed medication or medical, psychiatric, psychological or other professional care.

32. HEALTH PRECAUTIONS AND PARTICIPATION

Some peiec® practices, techniques or activities may not be appropriate for every person or in every circumstance.

Additional caution, modification, postponement or appropriate professional advice may be required in circumstances including pregnancy, particularly during the first trimester; implanted electronic or medical devices including pacemakers; recent surgery or medical procedures; acute injury, trauma or significant inflammation; serious or unstable medical conditions; acute or unstable psychiatric or psychological conditions; active medical or psychiatric care where participation may affect that care; or another circumstance in which participation may reasonably require modification, postponement or additional consideration.

This is not an exhaustive list.

The presence of a particular condition or circumstance does not necessarily mean that all peiec® practices are inappropriate. Different techniques and activities may involve different precautions.

Detailed precautions, contraindications and appropriate application may be addressed as part of relevant education and participation information.

Participants should communicate information reasonably relevant to safe participation where requested and should not undertake an activity where they reasonably believe it is inappropriate or unsafe for them.

Peiec International may reasonably modify, pause, postpone or decline participation in a particular activity where necessary for safety or appropriate program delivery.

In an emergency or where urgent medical or psychiatric assistance is required, participants should seek appropriate emergency or professional assistance rather than relying upon Peiec International education or a peiec® practice.

33. PERSONAL RESPONSIBILITY

Participation in Peiec International offerings is voluntary.

Participants are responsible for communicating relevant concerns where reasonably necessary for safe participation, working within their reasonable physical and personal limits, following reasonable safety and participation instructions, seeking appropriate professional assistance where necessary, and making their own decisions concerning their health, wellbeing, professional practice and personal circumstances.

34. NO GUARANTEE OF PARTICULAR RESULTS

Individual experiences and outcomes vary.

Peiec International does not guarantee any particular physical, health, emotional, personal, developmental, professional, financial, business, certification or practitioner outcome.

Testimonials, study findings, case observations, demonstrations and participant experiences describe the experiences or findings applicable to the people involved and do not constitute a promise that another person will experience the same result.

Nothing in this section limits any guarantee or right that applies under the Australian Consumer Law.

35. BUSINESS AND PROFESSIONAL RESPONSIBILITY

Where Peiec International provides business, practitioner or professional-development education, that information is educational in nature.

Peiec International does not guarantee that participation will generate clients, income, business growth, employment or any particular commercial result.

Participants remain responsible for their own professional decisions and for understanding and complying with laws, insurance requirements, professional standards, registrations, licences, tax requirements or other obligations applicable to their own practice or business.

36. THIRD-PARTY PLATFORMS AND TECHNOLOGY

Peiec International may use third-party platforms to provide courses, communications, payments, scheduling, video conferencing, communities or other services.

Reasonable changes to third-party platforms or technology may occur from time to time.

Peiec International is not responsible for temporary interruptions or failures caused solely by third-party systems or circumstances outside our reasonable control, but will take reasonable steps to restore or provide appropriate access where necessary.

Participants are responsible for having reasonable internet access and compatible equipment required to participate in online offerings.

37. LIABILITY

Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Subject to those rights and to the maximum extent permitted by law, Peiec International is not liable for loss or damage caused by:

a participant’s failure to follow reasonable instructions or disclosed precautions;
misuse of Peiec Materials or techniques;
use of Peiec Materials or techniques outside the participant’s authorised education or scope;
a participant’s failure to communicate information reasonably relevant to safe participation where requested;
a participant’s independent professional, business or personal decisions;
acts or omissions of another participant or unrelated third party;
failure of technology outside Peiec International’s reasonable control; or
circumstances outside Peiec International’s reasonable control.

Nothing in these Terms is intended to exclude liability where doing so would be unlawful.

38. AUSTRALIAN CONSUMER LAW

These Terms operate alongside, and do not replace, rights provided by the Australian Consumer Law.

Where the Australian Consumer Law applies, our services come with consumer guarantees that cannot be excluded.

If there is an inconsistency between these Terms and a consumer guarantee, right or remedy that cannot lawfully be excluded, the applicable law prevails.

39. COMMUNICATIONS

Participants are responsible for providing accurate contact information and keeping relevant details reasonably current.

Important communications may be sent electronically using the contact details supplied during application, enrolment or purchase.

Participants are responsible for reviewing communications reasonably connected with their enrolment or participation, including information concerning program requirements, immersion arrangements and changes to scheduled activities.

40. CHANGES TO THESE TERMS

Peiec International may update these general Terms from time to time to reflect changes to our business, services or legal requirements.

Changes will apply prospectively unless otherwise permitted by law.

Terms specifically agreed in relation to an existing enrolment will not be materially altered to the participant’s detriment merely by publishing new website Terms.

The version applicable to a particular transaction or enrolment will generally be the version in effect when the relevant agreement was entered into, together with any later variation validly agreed between the parties.

41. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent necessary where possible.

If it cannot be read down, it will be severed without affecting the remaining provisions to the extent permitted by law.

42. NO WAIVER

If Peiec International does not immediately enforce a right under these Terms, this does not mean that right has been waived.

A waiver in one circumstance does not constitute a waiver of the same or another right in a different circumstance.

43. ENTIRE AGREEMENT AND SPECIFIC OFFERING TERMS

These Terms operate together with any specific program information, enrolment terms and separate written agreement applicable to the offering purchased.

Where a specific program term or signed agreement expressly addresses a matter differently from these general Terms, the more specific provision will apply to that matter.

44. GOVERNING LAW

These Terms are governed by the laws of Western Australia and applicable laws of the Commonwealth of Australia.

Subject to any rights a participant has to commence proceedings elsewhere under applicable law, the parties submit to the jurisdiction of the courts of Western Australia and courts entitled to hear appeals from those courts.

IMMERSION CANCELLATION, REFUND & LIABILITY POLICY

Cancellation Policy

We understand that unexpected circumstances may arise. However, due to the extensive preparation, venue commitments, staffing, and logistical arrangements involved in hosting immersive in-person experiences, the following cancellation terms apply to all bookings.

Up to 5 Months Prior to Commencement

Participants may cancel their booking and receive a refund minus a $299 administrative fee.

Refunds will be processed within 30 business days to the original payment method.

Please note:
Sano Academy and Peiec International are not responsible for payments made to third-party providers, including airlines, hotels, transportation providers, or travel services.

Between 4–5 Months Prior to Commencement

Refunds minus the $299 administrative fee will only be provided if:

the participant supplies a suitable replacement attendee approved by Sano Academy; or
Sano Academy is able to fill the participant’s place from a waitlist or future applicant.

Within 3 Months of Commencement

Due to the substantial preparation and commitments associated with Immersions, cancellations made within 3 months of commencement are non-refundable.

What Your Immersion Fee Includes

Unless otherwise stated in writing, Immersion fees apply only to the official Immersion package and inclusions outlined at the time of booking.

Immersion fees do not include:

flights
visas
travel insurance
accommodation outside official dates
transportation outside official dates
meals outside official dates
personal expenses
tourist activities
third-party bookings or services

Participants are responsible for organising these independently.

Travel Responsibility

While guidance regarding logistics may occasionally be provided, all travel arrangements remain the responsibility of the participant.

This includes, but is not limited to:

flight delays or cancellations
missed connections
lost luggage
visa or passport issues
illness or injury during travel
transport disruptions
geopolitical or weather-related disruptions

No refunds or credits will be issued for missed Immersion time due to travel-related delays or disruptions.

Participants are strongly encouraged to obtain comprehensive travel insurance.

Limitation of Liability

To the fullest extent permitted by law, Sano Academy, Peiec International, Anandi Sano, staff, contractors, and representatives are not liable for:

travel-related expenses or disruptions
personal injury or illness
theft, loss, or property damage
cancellations or changes outside our control
missed travel or accommodation arrangements
indirect or consequential losses arising from participation

Participants attend all Immersions voluntarily and at their own responsibility.

Travel Insurance

Comprehensive travel insurance is strongly recommended and should include cover for:

medical emergencies
cancellations
travel interruption
missed flights
lost luggage
personal liability
